Please read the following terms and conditions of this Agreement carefully before using Smartmark Benchmark and the license file ("this Software"). By downloading the software, you agree to be bound by the terms and conditions of this Agreement.
A temporary license is required to try out this product. Please contact us for details.
If you want to benchmark a real mobile, it must be compatible with this software. If you wish, we can demonstrate this Software to you.
Software License Agreement
1. Software License Agreement
ISB Corporation ("ISB") grants you the following rights:
a) This Agreement grants you the right to install and use this Software on a hard drive or storage device on a single computer that you possess in order to use this Software by yourself.
b) You may use this Software only for trial use and evaluation purposes. The trial period of this Software is specified in the license file.
2. Copyrights and Intellectual Property Rights
All copyrights and intellectual property rights in and to this Software developed by ISB belong to ISB. This Agreement does not grant any express or implied rights to you, except as the rights granted herein.
3. Restrictions
You agree to the following in order to use this Software.
a) You may not make a copy of this Software, except for back up purposes.
b) You may not transfer, sell, or re-use this Software, either in whole or in part, to any third party.
c) You may not alter or modify the source code of this Software and reverse-engineer, decompile, or disassemble this Software, or permit or authorize a third party to do so.
d) You may not export or re-export this Software, directly or indirectly, to any country, person, or entity.
4. Disclaimer
a) The software is provided "as-is" and without warranty for system or other failures, data loss, the existence of bugs, performance or effectiveness of OS functions (including disk repair, system or other restoration functions)
in relation to the use of this software.
b) In no event shall ISB have any liability for any general, special, direct, indirect, consequential, incidental, or other damages (including damages for loss of profits or lost savings) incurred due to the use of or inability to use this product, even if ISB has been advised of the possibility of such damages.
5. Support Services
In no event shall ISB have any liability for any support service for maintenance and modification of this Software.
6. Termination
In case you breach any of the terms of this Agreement, ISB may forthwith terminate this Agreement without any notification.
